Public Order Offences
Have you had a PCSO or a local authority issue a Fixed Penalty Notice against you for throwing a cigarette butt on the floor / spitting on the floor / your dog barking too loudly / your baby crying too loudly etc., or for any similar alleged offences? Whilst some of you may feel aggrieved at this imposition, I’m sure there are many of you who feel “that’s only right”.
The lawful fact is, many of these ‘quality of life’ laws are only enforceable with your consent and compliance! (See About Us page). Worse, they are often enforced with a contradictory abuse of law; for example these FPNs often state you must give the enforcing agent your name and address under S1 of the Road Traffic Offenders Act 1988 or or you will be charged with committing a criminal offence. Yet how is it the enforcing agent and/or local authority are allowed to cite ‘criminal’ enforcement for a ‘civil’ penalty?!
The above is just one of the issues Consumerletters.co.uk raise in our appeals against these FPNs to successfully negate the enforcement of them. We have no problem with the ‘lawful’ enforcement of FPNs – the problem is, they rarely ever are and it’s only your ignorance of law (in conjunction with aggressive enforcement language and tactics) and then your subsequent compliance that enables enforcement of these FPNs. (See About Us page).
What do I need to do? Complete our Application/Consent Form, attach the FPN & press SEND. Consumerletters.co.uk will then determine the validity of your case and if I can help, I will then contact you to make a payment via our online Payment Form.
